Court throws out KC Luxury’s application challenging an order extending his detention over alleged c%caine trafficking

A Federal High Court in Lagos has dismissed an application by socialite Afolabi Kazeem Michael, popularly known as KC Luxury, challenging an order extending his detention for 30 days over his alleged involvement in trafficking 184.5kg of c%caine.

Justice Akintayo Aluko, in a ruling delivered on Thursday, upheld the detention extension order granted on August 20, 2026, ruling that it was validly made and supported by the Constitution and relevant drug-control laws.

KC Luxury, through his lawyer, Abdulakeem Labi-Lawal, had asked the court to set aside the order, arguing that the Federal High Court lacked jurisdiction to extend his detention. He contended that remand orders could only be issued by a magistrate’s court under Sections 293 to 299 of the Administration of Criminal Justice Act (ACJA), 2015, and that the detention violated his constitutional right to personal liberty.

However, NDLEA counsel, Abu Ibrahim, argued that the August 20 order was not a remand order under the ACJA but an extension of detention granted to enable the agency to conduct further investigations into the alleged drug-trafficking offence.

In dismissing the application, Justice Aluko held that Sections 293 to 299 of the ACJA did not apply to the case. He also ruled that the Federal High Court has exclusive jurisdiction over drug-related offences under Section 251(1)(m) of the Constitution and Section 26(1) of the NDLEA Act.

The court further found that the NDLEA had presented sufficient evidence establishing reasonable suspicion that KC Luxury committed a drug-related offence, making the temporary deprivation of his liberty permissible under Section 35 of the Constitution.

The judge consequently dismissed the application, describing it as an abuse of court process and lacking in merit.

KC Luxury was arrested by NDLEA operatives on August 13 at Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris, France. The agency linked him to the seizure of 184.5kg of c%caine.
