Couple Sues Fertility Clinic after Embryo Mix-up Results in Birth of Non-Caucasian Child That’s Not Theirs

A Florida couple, Tiffany Score and Steven Mills, is suing Orlando’s IVF Life, Inc., and Dr. Milton McNichol after an embryo mix-up led to the birth of a child not genetically theirs.

The couple had stored embryos in 2020, but when one was implanted in April 2025, they gave birth to a “healthy female child” whose appearance did not match theirs. Genetic testing confirmed the baby is unrelated to them.

The couple fears their own embryo may have been implanted in another patient. While they have bonded with the child, they want her returned to her genetic parents if requested.

The lawsuit seeks emergency court action requiring the clinic to alert all affected patients, conduct genetic testing, and disclose if other families were affected. An emergency hearing was held before Judge Margaret Schreiber, with the clinic stating it is cooperating with the investigation.
